ABOUT THESE TERMS AND CONDITIONS

These General Terms and Conditions expressly regulate the relationships arising between JBZ DISRUPTIVE COSMETICS, S.L.U., with registered office at Avenida Puigcerdà No. 7, Polígono Industrial “El Pla,” 08185 Lliçà de Vall, Barcelona, Catalonia, Spain, and C.I.F. B-04980389 (hereinafter “JBZ”), and third parties (hereinafter referred to as “Users” or “You”) who register as users and/or purchase products (hereinafter “Products”) through JBZ’s official online store (https://contesdeparfums.com/, hereinafter the “Store”). These Terms and Conditions, together with your Order Confirmation, constitute the contract between JBZ and you for the supply of Products. No other terms or conditions shall apply. The contract cannot be modified unless JBZ agrees to do so in writing or by email.

USER OBLIGATIONS

The User agrees, in general, to use the Store, purchase the Products, and use each of the Store’s services diligently, in accordance with the law, morality, public order, and these Terms and Conditions, and to refrain from using them in any way that may hinder, damage, or deteriorate the normal operation and enjoyment of the Store by other Users or that may harm the goods and rights of JBZ, its suppliers, other Users, or third parties.
To place an order, you must be at least 18 years old.

PRODUCTS AND PRICES

JBZ reserves the right to decide, at any time, the Products offered to Users through the Store. In particular, JBZ may add new Products to those currently offered, and unless otherwise stated, such new Products will be governed by these Terms and Conditions. Likewise, JBZ reserves the right to discontinue or cease offering access to any type of Product at any time without prior notice.

The Products included in the Store will correspond as closely as possible, as web display technology allows, to the Products actually offered. However, please note that handmade products may have slight variations due to the manual manufacturing process. Product features and prices are listed in the Store. Prices are shown in Euros and include VAT unless otherwise indicated.
Products purchased online are not eligible for “Tax Free”.

PRODUCT SUPPLY AND PAYMENT

Users who purchase a Product via the Store must pay using the payment methods specifically detailed on the website.
Any order placed through the JBZ website must be paid immediately prior to the order confirmation using the available payment methods.
Within a maximum period of twenty-four (24) working hours, JBZ will send a confirmation email to the user.

According to Article 18 of Royal Decree 403/2020 of March 14, 2020, transport operators are considered CRITICAL OPERATORS OF ESSENTIAL SERVICES. Therefore, during a state of emergency, they are required to take the necessary measures to ensure delivery of shipments, especially to hospitals, health centers, pharmacies, and private homes containing health-essential products.

JBZ will store electronic documents in which the purchase contract is formalized, such as the User’s Order and the Order Confirmation. These documents will be written in Spanish.
The Order Confirmation sent by JBZ does not serve as an invoice, only as proof of purchase.
Prices are indicated on each product page and may be changed at any time. The valid price will be the one in effect at the time of purchase.

Although JBZ will make every effort to supply the Products listed in your Order Confirmation, it is possible that certain Products may no longer be available or cannot be sourced from the manufacturer or distributor.
Gifts and samples may not always be available in click & collect orders. Please contact customer service after placing your order for confirmation.
Gifts associated with purchases and samples included in the try & buy service are exclusive to the website and are not guaranteed for in-store purchases.

RIGHT OF WITHDRAWAL

Users have the right to withdraw from their purchase by contacting JBZ via email at info@contesdeparfums.com within a maximum period of fourteen (14) business days from receiving the Products. Products must be sent back after requesting a return through “my account” at www.contesdeparfums.com and receiving authorization. A copy of the delivery note or invoice must be included. Return costs, including transport, duties, fees, and any other taxes, will be borne by the User.

The right of withdrawal cannot be exercised if Products have been opened, used, or are not returned in their original packaging and perfect condition.

RETURN OF DEFECTIVE PRODUCTS

Returns and exchanges are accepted only in cases of defective Products or valid withdrawals as per these Terms and Conditions.
Returns must be made within 15 days of purchase confirmation. Products must be returned in the same condition as received, with original packaging and tags. JBZ will determine whether the returned items are in original condition. Incomplete, damaged, or dirty products will not be refunded.

If the return conditions are not met, JBZ will inform the User via email. Rejected items will be kept for 2 months, during which time they can be collected at Av. General Mitre nº 15, 08017 Barcelona, or shipped to the User at their own expense.

Shipping costs for returns (including duties or customs charges) must be covered by the User.
In the case of a defective product, JBZ will try to replace it with the same or a similar product. If a refund is requested instead, it will be issued via the same payment method used for the purchase, once approved.
Shipping issues such as loss or delay are the responsibility of the courier. JBZ is not liable for such incidents.

HOME DELIVERY SERVICE

Products will be delivered to the address provided by the User, within mainland Spain. Delivery time is up to 30 days by law.
JBZ works with various reputable logistics companies. No deliveries will be made to P.O. Boxes, hotels, or temporary addresses.

Shipping costs are not included in product prices and will be shown at checkout. Any customs duties or fees are the responsibility of the User.
The customer must provide a valid delivery address where the shipment can be received during normal business hours. If not, JBZ assumes no responsibility for delays or failed delivery.

Shipments are insured as per the courier’s specific coverage. Compensation, if applicable, depends on the courier’s acceptance of the claim and insurance terms.
JBZ does not ship to the Canary Islands, Ceuta, or Melilla.

INTELLECTUAL AND INDUSTRIAL PROPERTY

The User acknowledges that all elements of the Store and each Product, including information, materials, trademarks, structure, layout, and software, are protected by JBZ or third-party intellectual and industrial property rights. These Terms do not grant any rights other than those explicitly mentioned.

Users may not reproduce, alter, reverse engineer, rent, lend, distribute, or make public any of the Store’s content unless legally permitted or explicitly authorized by JBZ or relevant rights holders. Use is restricted to personal, non-commercial purposes.

APPLICABLE LAW AND JURISDICTION

These General Conditions are governed by Spanish law and are available to regulatory bodies.
Any dispute regarding the validity, interpretation, performance, or termination of this contract shall be submitted to the courts of the city determined by the most appropriate competent body within Spain.

MEASURES RELATED TO PRODUCT SALES

According to Article 21 of Royal Decree-Law, during a state of emergency or its extensions, the deadlines for returning products purchased either online or in person are suspended and will resume once the state of emergency ends.
This may affect the regular 14-day legal withdrawal period and could lead to interpretation conflicts in cases of extended return periods or commercial guarantees.
